Terms of Service

These Terms of Service ("Terms") are an agreement between you and MyOfficial LLC ("MyOfficial", "we", "us") governing your use of the MyOfficial mobile app and this website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use MyOfficial

You must be at least 18 years old to use the Service. MyOfficial is intended for adults, and we do not permit accounts for anyone under 18. You must also be able to form a binding contract. If you use the Service on behalf of a team, league or organization, you represent that you are authorized to bind that entity to these Terms.

2. Your account

Provide accurate information and keep it up to date.
Keep your password confidential. You are responsible for activity under your account.
Tell us promptly at support@myofficialsports.com if you believe your account has been compromised.
One person, one account. Do not impersonate anyone or misrepresent your officiating credentials or affiliation.

3. What MyOfficial does and does not do

MyOfficial is a scheduling and communication tool for sports officials, assignors, teams and organizations. We provide the software. We are not a party to any assignment, engagement or agreement between an official and an assignor, team or organization. We do not employ officials, do not guarantee that any game will be assigned or played, do not verify anyone's certifications or background, and are not responsible for payment between users. Any pay amounts shown in the app are entered by users, and settling them is between those users.

4. Acceptable use

You agree not to:

Post or send content that is unlawful, harassing, abusive, hateful, threatening, defamatory, obscene, or that infringes someone else's rights;
Use the Service to spam, phish, or send unsolicited commercial messages;
Upload malware, or attempt to breach, probe or disrupt the Service or its security;
Scrape, harvest or bulk-export other users' personal information;
Access the Service through automated means except as we expressly permit;
Use another user's account, or share your account with someone else;
Use the Service to break any applicable law or league rule.

5. User content and moderation

You keep ownership of the content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content solely to operate and provide the Service.

We do not tolerate objectionable content or abusive users. The app lets you block a user and report a message. We review reports and may remove content, restrict features, or suspend or terminate accounts that violate these Terms — in urgent cases without prior notice. Reports are reviewed and acted upon within 24 hours where they concern abusive or objectionable content.

6. Fees

The app is currently free to download and use. If we introduce paid features in the future, we will present the price and terms before you are charged, and any purchase made through an app store is also subject to that store's terms.

7. Termination

You may stop using the Service and delete your account at any time — see Delete your account. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections 3, 5, 8, 9, 10 and 11 survive termination.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NOTIFICATIONS WILL ALWAYS BE DELIVERED. YOU ARE RESPONSIBLE FOR CONFIRMING YOUR ASSIGNMENTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYOFFICIAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, OR MISSED OR DISPUTED ASSIGNMENTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD 50. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

10. Indemnity

You agree to indemnify and hold harmless MyOfficial and its officers, employees and agents from any claim or demand arising out of your content, your use of the Service, or your breach of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-law rules. The state and federal courts located in Wisconsin will have exclusive jurisdiction over disputes, except that either party may seek injunctive relief in any competent court.

12. Changes

We may update these Terms. We will change the "last updated" date above and, for material changes, notify you in the app. Continuing to use the Service after a change means you accept the updated Terms.
